when you're huaband have no job what about child support$ you won't get nothing or what? (not divoce yet)he have nothing. no house no car....... oklahoma .

File child support paperwork ASAP. Regardless of him not having a job, it is not your problem. You're obviously doing what it takes to take care of your kid and he needs to as well, even if the district attorney has to enforce it! I'm not sure where you are located, but here in California there are consequences for not paying child support. The absentee parent can have their driver's license suspended if they are more than a month late on child support. Also, professional licenses (if he is an electrician, contractor, etc) can be suspended as well. He can also be jailed for not paying child support. Even if he has no job, they will STILL make an order for support. Granted, you may not get much if they can not verify his income. My ex lied about his income (he was being payed under the table by his parents) and they based it off of the fact that he should be able to make $8 an hour, 40 hours per week. During that time, I was receiving $240 a month, plus medical benefits for my daughter. Once I found out he had verifiable income nearly 4 years later, I took him back to court and began receiving $603 a month. One last thing, don't worry about what he says to your child. If your child asks or mentions it, just tell him that both parents have a responsibility to support their kids, emotionally and financially. Good luck!

That is pretty much the way it goes, but it doesn't go that way for long. The courts will force him to get a job and if he's not paying child support, file a contempt motion on him. If he doesn't comply then he'll be sitting in jail. You could also apply for assistance. I know back in the day, the courts use to look at that as a sign of not being able to take care of your children, however times have changed and it's no longer an issue as long as the children remain your first priority. There's also a bonus to being on assitance...they assign a special worker to enforce your child support order and they are relentless is getting the non-custodial parent to hold up their obligation.

I'm sure you are also going to get responses about him not paying if he's in jail, so I thought I should inform you that dead beat parents are allowed huber privelages to either look for work or get a job while in jail. They aren't allowed to just sit there and bide their time. It is one positive thing the federal government has enforced.

Depends on his particular situation.
The meter keeps running generally speaking, and judges usually tell father's to get a job or go to jail (as if going to jail raises any prospect of getting a good job). Now in as far as you getting anything, well, blood from turnips, and all that stuff. You still might qualify for TANF, so don't give up all hope.

The court system will make him pay something to you or he will go to jail and work there.

Look up the Child Support Enforcement Agency in your city. I think there's one in every city in the US. They work for free in getting this sort of stuff straightened out for you. Also try the Health Department and Social Services to see what benefits you will be eligible for.

Make sure you have your husband's SSN and as much personal info. as you can about him before it gets worse. You will need this info. to pass it on to those who will help get child support from him for you.

you wont get anything until he gets a job, but they have that new law in oklahoma, if you are divorced, hes supposed to pay child support, if he doesnt he will lose his drivers license, and go to jail. I live in Oklahoma too. Is there any help you need? What part?

do you live with him???... if not then you need to file for child support.. they will make him get a job or go to jail, lose his car, take his tax money, if you go on welfare,,,they will really go after him because the state wants their money back quickly...they have fatherhood intitiative programs that will help him find a job.. it takes a long time.. but eventually they will have a court order..and he will have to do whatever he has to to support the children. .

You get part of what he has.

If he has a job, you get part of his pay.

If he has a trust fund, you get part of that.

If he has nothing, you get your share.

But you need to get to court and get it started.

The judge will tell him he needs to go and get a job or go to jail, he has a child to support.

If he does not, then he can go sit in jail for a while and maybe then he will do the right thing.

Of course, you question does not say much, he could be disabled or anything.

Divorce him, hit him up for child support and if he fails to pay it, let him tell it to a judge and see if the judge falls for his excuses.

go to court, get a legal separation. my husband wasn't working but the judge told him that it didn't matter because "the meter would keep running until he got a job"
