Yes, it will come out in the background check unless the records have been ordered sealed by a judge.

It will not automatically disqualify you but you would be wise to share this information with the perspective employer before they conduct the background check. If you answer all of their questions satisfactorily, you may still have a chance at getting their job. Sometimes it is beyond their control and that type of a misdemeanor will disqualify you.

You should talk to your lawyer about asking the judge to seal your record once you successfully fulfill your probation requirements.

Open the Yellow Pages and call every attorney in there until one answers your question. I do it all the time... It's not like they can charge you for answering a simple question. That, and the ones who take out time for you *now*, know that when you really need an attorney, you'll remember who answered their questions and call them back for real help. It goes by two names; "Free Advertising" and "You - Scratch -My - Back; I'll - Scratch - Yours"!
