i read a response to an earlier question of mine. and now i have an other question.

in NY, i know it's illegal to consume or buy alcohol at 21, but if a cop catches you with beer in the car (and pressuming that you're still 100% sober), will you get in trouble for possession of the beer with intent to consume or to sell to others? i imagine that the cop will either confiscate it or make you spill it, but as long as you are still sober, can he really do anything?

i'm smart enough to put it in my trunk. and you bring up a great point! the cop has no right to search my vehicle unless he knows that i have been drinking (which i wouldn't be while driving).

Yes, he can charge you if it's in the passenger compartment. If it is in the trunk and unopened it is permitted. And he can search the car if he heas reason to believe there is illegal activity or if you consent, which is usually wise. No need to make them more suspicious!

Depending on the investigating officer you could be charged with underage possession of alcohol. The norm is to confiscate it place it into evidence and give them some time to have the parent or someone of age to claim it; if this doesn't happen it gets destroyed. If the beer case is open and readily accessible to the underage driver then yeah charge him/her especially if the vehicle is theirs and registered as such. If it is just sitting in the car confiscate it. There are too many unstated factors to consider.

he can bust you, yes, I know people this has happened to. It is the container law. It assumes that if you have alcohol in the passenger section of a car that you have or will consume it while driving. That is why smart people put it in the trunk.

not as long as its not open and not yours. If you didn't buy it or drink it or sell it . guess you should of had it at least in the trunk. But if you where bringing it to your dads or mams well they may be able to take it its in your car and you are responsible for that and not old enough . It also depends on what ya done?

i am assuming that u mean under the age of 21. yes you can be charged with possessing the alcohol while under age. it is also a felony. some cops will just confiscate it. others will charge you. makes you wonder what the guys do who just take it from ya don't it.
