The eviction notice was given to me on the 20th of June and becuase I have section 8 I cannot leave the premises until I have been served with a petition from the court. I spoke with the landlord today and he said that he would go down to the court on Monday to file the petition. What I want to know is if I am liable for the full months rent in August considering the fact that if he collects rent from me for the month of August that the 30 day notice is voided due to the collection of rent after he served me to be off of the premises in the 30 days?

I am not sure if I understand the question. If you are being evicted because you didn't pay the rent and your lease goes through the month of August then yes, you are responsible for the full month rent. Also, you will more than likely lose your section 8 due to the eviction.

You are responsible for rent until you are no longer in the unit. Regardless of if you are on Section 8 or not. I'd contact your section 8 case worker and find out what type of options you have. You also have the opportunity to go to court and fight the eviction. I'd have to know more information to be truly helpful.

It should say in the eviction notice whether you pay or not. I f you're not sure ask the office that filed the papers.
