A friend of mine is unemployable in her field of 15 years, bc of her credit. She did land one job and they told her " due to your criminal activity, you will not be allowed to handle checks." Criminal activity being... her credit is colorful. She has been dinied jobs time and time again bc of this Act or Bill.

The act you are asking for is the Fair Credit Reporting Act. It is enforced by the Federal Trade Commission. All the info. you need is at:

If you apply for employment at a company, the employment application will most likely have language authorizing the company to check your credit report. They want to get an idea of your level of responsibilty when it comes to handling your finances. By signing the application, you then authorize them to check your credit.

Credit reports don't generally report information on checking account activity, but there are other companies (Chexsystems) that collect data on checking accounts which have been closed due to repeated overdrafts, etc. Credit reports report information on loans and credit cards only.

But it sounds like a previous post may be right...your friend probably isn't telling you everything.

Financial institutions can pull your credit report at any time, for any reason, IF you already have a loan or credit card with them (Loan applications and Loan Agreements have language authorizing the bank to do this). If you do not have an account with a financial institution, they have no right to buy your credit report...however, they will sometimes purchase lists containing the names and addresses of people who meet certain credit criteria (e.g. credit score over 800, etc)... when your credit score meets their criteria, you'll likely get a credit card offer from them in the mail, even though you've never done business with them.

When you go for employment in some areas they tell you up front that they will run your credit, or do a criminal background check. This is for the companies protection. She may need to find a career where she does not handle money.

It sounds like they ran a C.O.R.I. check on her. It's a criminal offense records investigation. She would have had to sign a waiver at the interview. The results of these investigations can sometimes take several weeks to come back to her employer, which is why they told her after she landed the job.

They don't "pull" the report. They buy it. The Credit reporting Agencies sell the reports.

I don't think she is telling you everything.
