Whoa! What is the wife's status? Did she enter on a fiance visa, then marry? Or was she an illegal alien? There is NO way to legalize an illegal alien. She has NO alternative but to return to her own country. Her children have a right to citizenship in her country of citizenship. She can obtain passports for them from her consulate, then take them home with her without any visa or immigration hassles. For her husband, she will have to apply for his immigration to her country of citizenship once she returns to her own country. Since she will be barred from reentry for 10 years, they had better live together in her country to prove it is a valid, enduring, "till death do us part" marriage - prerequiste for him to apply for her immigration visa AFTER her 10-year bar is up.
