Should judges assume mothers make better parents, as they do now, awarding them sole custody in 84% of all divorces in the US, or should fathers who are sharing childrearing be given joint physical and legal custody when they ask for it?

I think that both parents are equally qualified to raise a child on their own. I know of several fathers that have custody of their children and are doing a wonderful job of it. In divorce, we always need to remember that it is about the children and not ourselves. We have to come to terms with things and learn how to raise our kids being able to have both parents available to them.

joint custody is so hard on a child. stability is something they need so much of during the divorce. some, a very very few, fathers are better than the mother.... but thats a rare case if you ask me. i am divorced and have full custody. their father told them after 6 months of the old every-other-weekend that they should stop coming, they stress him out and should just stay home. nice guy, eh?
my parents were divorced, my mom had custody of my younger sister and my dad had custody of me. this was per mine and my sisters request. and my parents agreed, so the judge said ok. my lawyer said here in michigan it is almost impossible for a father to get custody unless both parents agree or the mother can be proved unfit. its too bad divorce is so rampant... its very difficult for the kids.

In making a decision based solely on the child's best interest, the judge looks at "Both Parents" background (ie:) If either have ever been arrested for whatever; job status; and if the child is old enough, I believe in Calif. 9 yrs of age is considered to be the status when a child can decide/knows right from wrong. I went through this.

I have three brothers two of them got custody of there kids one has a girl and boy one his two boys they both had good and bad points but both did a good job but I have one brother that had 4 kids with two wife's and he wasn't worthy to even have kids not in their lives now because he don't have the desire not because he had bad exwifes so yes some guys need to have custody and some do not and today there is more and more women that don't give a crap about there kids just kiss them and brag about them then leave them with there grandparents to care for there needs there is more dads out there that would be better for their kids but the grandparents will back there daughter up because they are afraid of losing their grand kids when they know the kids would be good with dad

well actually i think it all depends. My dad is a better father than my mom but my mom is funner. Judges should not assume mothers are the better parent at all. Maybe we should start a new law where you install camera's in the household for 1 week (place the camera's in places the parents dont know about) and if the mother is abusive and mean then.... you get the picture.

It depends on the person, not on their gender. My mom is fabulous and my dad is crazy and abusive, but it's just the opposite with my boyfriend (his dad has custody of him, and of his two siblings).

The courts are very unfair and biased in favor of women, generally speaking.

TO ME MY ,MOM is better with everything
but that is just me
i guess it depends on the person and the kids
it is different 4 every1.

that's deep... you may have statistics but it's just numbers... nobody can determine as to who raises a child better, if one is subtracted it can never be carried one...
