I know with in ground the filter system is higher than the pool...so in your situation I would think it would be below not above due to air and such.

The Short Answer is either, it makes no real difference.
The Long answer has to do with why?
Your pool should have two holes (or more) precut in it to accept return suction lines. If your pool does not have these then ask who you bought it from what is supposed to happen.
If your pool did come with such a return hole but you don't want the water level to be as high as that, then yes, your return can be above water level.
Not that most pools become unstable if the water level is not near the recommended levels
and some people do like being splashed in the face :o)

Below the waterline. You wouldn't want it blasting you in the face.
It could be partly or wholly diverted to a waterfeature like some sort of waterfall/slide setup. But that would be a little exotic for an above-ground unit.
