My roommate is moving out with 10 1/2 months on the lease left. We have found a replacement for him but he wants his security deposit money back. I have tried to tell him that no one gets the security deposit money back until ALL of the tenants have moved out. What are some legal definitions and wording I should tell him?

Tell the new roommate to give him his security deposit back or tell him to go #^@$ himself. He has to wait until the end of the lease like everyone else.

You didn't recieve his security deposit. Have him ask the landlord, you're not responsible for him moving out nor should you pay out of your own pocket for his money.

However, you can do is: Either have the new roomate pay his own security deposit and have the landlord give the old roommate back his security deposit. Make the neccessary changes on the lease or sublet whatever. This is more legit and saves you possible trouble later on.

Or, have the new roomate give his security deposit underthetable to the old roomate and at the end of the year, the new roomate gets the security deposit from the landlord.

I would also let the landlord know of the new person if you are switching roommates without him knowing.

You could try asking your new roomate for a share of the security deposit and then give that to the old roomate. there fore the old one gets his money back and the new one is covered also.
Thats what I would do, it seems only fair. Everyone living there pays in .. everyone gets paid out at the end.

I dont know about legal wording. But you should not be the one giving his his deposit back. It should be the landlord since he is the one your roommate is breaking the contract with.

You are not guarenteed to get your deposit back when you leave, why should he get his.

do not give him his money back, let the landlord do it.

I'd tell him that he has to wait. Also, he should consider it his "lease breakage fee". Doesn't matter that you found someone to replace him. He still broke the lease and there should be some penalty.

Tell him to talk to the landlord. You are not obligated to give him anything.
