Yes, even though pit road was closed and the lights were flashing. It would have been impossible to re-enter the track, since he was already commited to pit road. And since Busch's crew chief had thought this out, he wagered that NASCAR would rule in his favor, which is what they should have done, so they did their pit stop instead of a pass-through, which would have most likely resulted in the same penatly. Therefore, NASCAR goofed on this and should have determined that it would have been impossible for him to re-enter the track, a.k.a he was already commited, without ruining his racecar or endangering the drivers coming through on the track. Also, the way he was held at the end of his stop was more than enough, even if he was waiting for the field to pass by. Therefore, NASCAR made the wrong call on this. I have the exact rule for this. It is stated in layman terms, that when a driver is entering pit road UNDER caution, the driver is assessed a pentatly to be determined by NASCAR. Notice the word under, Busch was pitting when the caution was coming out. At any other track, he would have been past the commit cone and no penatly would be assessed.

Hard to say. Yes, the light was red when he entered the pits, but it changed so close to entry that there was no way he could have avoided it.
By the time his spotters knew he had violated the red light, he didn't have the option of going past his pit and rejoining the race (negating the penalty).
If NASCAR told him that he violated and would be penalized before he stopped in his pit stall, then he should have kept going and they don't have anything to complain about.
With the amount of electronics that they have in the races nowdays, there should be a way to instantly let the crew know whether or not the vehicle broke the red light rule and have the option to keep going and avoid the penalty.

Pit road was closed. Kurt was already commited to pit. Plus Kurt pitted when he could of just gone down pit lane without stopping.
Basically, he's crew just screwed up.
