i recently had a 60K mile maintennance on my 1998 mitsubish eclipse. shop kept my car for 2 weeks and charged $2000. they told me i had a 12K mile or 1 year warranty on the car. one week later my car broke down again. shop is now telling me that the water pump broke down causing the head gasket to blow and the engine to melt. they are keeping the car for 4 weeks (estimated) and want to charge my $2500 because they say the pump is not covered on a maintennance warranty. i want to take them to small claims court. do i have a case?

I'd take my ride to another shop with a great reputation, take the paperwork of the previous repair and ask them to diagnose the failure, to see if it is related to the last work by the other shop. If yes, document it well and sue in court. Be ready for a long drawn out process.

To me it sounds like you're paying almost for a new/rebuilt engine. You really need to know if you were had by shop #1.

Hmm, no not really. What did the 60k mile service consist of? Also, usually if the timing belt and stuff were replaced under that service interval, they should've recommended to replace the water pump as a PM measure. Since more and likely the water pump is driven by the timing belt. Hope that kind of helps.

Small Claims Court, may get you a "judgment". MAY!
That with $2500.00 will get your car out of the shop.

Judgments by Small Claims Court do not guarantee "Money".

A Law Suit may, if you have about that much for an attorney.

You might want to read the warranty to see what it covers before you pay out any more money or taking any legal action.

Of what, I have no idea!

But, it worked for them the FIRST time!

Why NOT try it again?

Did you ever hear about the poor lawyer, in a small town? Then, another lawyer moved in, and they BOTH got RICH!!!
