To be honest, she is entitled to half of everything, regardless as to whether she is in the wrong or not, you really need to get a Solicitor and he/she will be able to guide you in the right direction and tell you what you can/cant do, a neighbour of mine had a similar problem, his wife left him for another man and left the children with him, what happened there, was, she will get half of the house, but he didn't have to sell the house until the children had left school, and........she had to pay him maintenance for the children's up keep, keep that in mind, so even though he will have to sell the house, the judge was in favour of the man and let him keep the house until the children were old enough, he could of bought her out if he wanted, but he couldn't afford to do so, shame really cos the houses prices have shot up since that happened, if he had of paid her off 12 years ago all the profit on the house would be his, now she will be laughing as she gets far more now than she would of got 12 years ago. Before you go to a solicitor and pay money, go the Citizen's Advice Bureau in Chester for free.
They will be able to give you all the info you need about rights to property. There is not, to my recollection, an entitlement to half of the property or anything else automatically. Though you also need to think about whose name(s) is on the deeds as well. The thing is that seperated people have rights which will change on divorce. also the needs of the children and who will care for them are important factors.
However, she may well have rights to return to the matrimonial home prior to divorce. Check it out.

She will probably get 50% of your joint assets. There is a good old saying, though. If your wife leaves you for another man, the best thing you can do is let him keep her.

well, if you are still married you may be able to get her with adultery, which i don't know the law where you live, but where i live if you can prove that your spouse is cheating on you then you can usually get alimony, which could be a bargaining tool for you, because I'm sure she isn't going to want to pay you every month for the rest of your life, just because she left doesn't mean she got a legal separation which means she is married and cheating, just something for you to think about, but no matter what you need to see where you stand legally and check out for your state the thing about alimony. Hope this helps you out, i don't have any respect for cheaters.

Until the children have left home and are living elsewhere, none, but once they leave, she can claim half of ALL joint possessions purchased during the marriage. Rough, I know, and wrong.....but the law has always been an ***.

To me she left so fukk her she should have no right but, depending on where u live and most are community property the court will split the house unless u have a good lawyer.

If she walked out and abandoned she has nor right to the house, but if she had a ligitimate reason why she had to leave she can come back and claim her half of the estate.
The children are older and can decide who they want to stay with.
If your wife left you for another Man, she will never prosper in life with any Man,. she will develope a name for herself construed upon lame permiscuous habit forming herat that will follow her all her days.

If your in the UK, and both you and your wife have signed or if you both have your names on the tenancy then yep...she can waltz back in whenever she pleases!
If you make an appointment to see the landlord for your house and explain the situation (prefably before she plays it dirty on you and gets to the landlord first withsome heart tearing lie that you wont let her back in!
All your landlord will do is ask her to sign the house to you, then the courts stamp the tenacy that she wont be on, give it back to your landlord so it can go on your file.
Thats it, as simple as can be.

She has rights to half the cost of the house. If she files for divorce or you do, then all marrital property must be split 50/50 (sell the house or you must buy her half and pay her for it).

Well seeing as she is the MOTHER of YOUR CHILDREN, i say be civil and give her half. Whats the point of stoopin down yer level and being a b*tch about it, move on. Even though she left you think of the advantages, now you know the truth, now you can move on and still be friends.
