No, but it's not that simple. Each case is individual and unique. And there is no way to adjust for that. When a law is made, it has to be general, and cover every case with that one law. Situation: A guy kills someone for no reason, just because he gets off on killing. Another guy does the same, but for the reason say....maybe his wife, family was killed, raped, whatever, by the guy he killed. Do you think both of these murderers deserve the same sentence? It doesn't matter. Maybe the judge or jury would be more lenient in the latter situation, but it doesn't change the law. There is still a minimum sentence that is the same that applies to both people. If a person is found guilty of murder, which both men did, that minimum applies to both. You can't make a law that adjusts to each individual case. If so, then it would be up to one person, a judge, to interpret. And that is damn scary. There has to be general laws, and usually they are made a fair as possible.
So no, I don't think the justice system is fair, but I don't think there is a whole lot that can be done to make it more fair. I wouldn't want my fate to be decided by one judge, depending on which one got my case, the luck of the draw. there are too many self-rightous know-it-all judges out there. No, I'd take my chances on the laws that were written as fair as possible, to cover all cases for a specific crime. That really is as fair as it can be. Unless we want to resort to fascism, which each individual judge being the fascist. No thanks. Too many ignorant judges out there. Who often think they know more than the laws that were written. And are rarely right about that.

No, I don't think the justice system is fair. Although, compared to other countries, it's the best going. I do believe that "money" buys justice. Then again, the higher power, ensures justice one way or another. Peace , Claudia

It will never be perfect, if anything it is way to fair to the criminals. The justice system should be extremely harsh with criminals, right now the system is not fair to the victims of crime. Blame it on all the bleeding heart liberals in Ontario and Quebec because apparently to them, rapists, murderers and pedophiles deserve fair treatment when they should be executed instead.

My girlfriend is currently dealing with a court case.Her home was burglarized earlier this year,and the thieves were caught.
The prosecuting attorneys are so incompetent,and have handled the case and the evidence so badly,that these criminals are about to walk free.
Meanwhile there are cops out writing tickets for speeding,parking violations,etc.They even used to trek 1/2 mile back in the woods to harass me and my friends when we were teenagers.Granted,we were breaking the law by drinking under age, and smoking whatever we were smoking,but do they have nothing better to do?
I've seen cops and courts just totally screw people who really weren't a danger to anyone,but let some dangerous folks walk on a technicallity.
If you ask me.....while we still have murder,rape,robbery and other heinous crimes I really don't think cops should be screwing the public they're suppossed to be protecting by writing ******** tickets for minor offenses.

They show on television that most crimes end up with the prosecutor and the defendant's lawyer making deals and putting it in front of the judge for sentencing.
They say these are real life stories. So it must be true.
Is that fair? Is this justice?

Life is not fair. No one ever said it was.
If the justice system was fair, young offenders would be made to pay the consequences of their actions, not be covered up for. Their names would be released as a deterrent to further crime and so the public would be aware of who to watch out for.

I've seen too many criminals get away with crimes because the "justice system" gave them more rights than their victims. I know the founding fathers meant well with their writing of the Constitution, but there is no way they could've forseen the atrocities we'd manage to involve ourselves in as the human race.

No. It seems the more money you have you can get away with just about anything. Really good lawyers cost a lot of money and the average criminal is forced to take a public defender just out of law school. I don't call that fair.
