My ex-husband is a violent drunk and we divorced last year my daughter is 2 in September, he has never bothered to come and see her or acknowledge she is alive, I have a new partner now, i was wondering if there is any way to have his name removed from her birth certificate?

Since your ex-husband has not seen the child in some time, it may be possible to have his parental rights terminated. In most states, after a period of no-contact, you can file to have his parental rights ended and then his name can be removed from the birth certificate.

Is he paying child support for your daughter? This could complicate matters some, since the payment of child support is considered contact, even if he does not see the child.

In addition, most judges will not sever a person's parental rights unless there is someone else available to adopt the child in his place. You and your new partner would need to be in a stable marriage of at least one year, and your new husband would need to be willing to adopt the child. This will make him the father of your daughter in all legal ways.

The answer is very simple. NO. He is still her father. At least you attested to that fact when you bore the child, and you are again attesting to it here. You may have a new "partner" but she will always have been sired by the one man who is her father, unless you can find some way to put the baby back into the womb.

I suggest you stop being so bitter about the experience, learn from it, and live the life you have left. Stop holding grudges and stop trying to find ways to hurt your ex husband. Let your daughter live her own life and make her own decisions. There will be a day when she will want to know about her father. Then she will be old enough that you wont be able to hide the info from her. Additionally, the only person who might gain anything from this is you. You might have some temporary satisfaction, but it will hurt you more in the long run. Spite always does.

In some states if the new husband adopts the child you can have the birth certificate changed to reflect the child's new name.

There is very little point in this excercise, whatever you do will not change the fact that this man is her father, and she has a right to know who her biological father is, she may want to find/meet him in years to come, whatever you feel about him, is irrelevant, sorry but you have to just put the past behind you, get on with life and your new partner, fatherhood is more than biology, she will find this out for herself, at least you had the guts to get this man out of your life!

To have his name removed, you must either have him give up his parental rights voluntarily or have him proved unfit then you can remove his name from the birth certificate. Good Luck!!

No of course not. If he is the father he is and that is that. He may not be the natural father but if it is his name on the certificate he is the legal father and that cannot be altered.

I looked online for you and didnt really find anything that pertained to your particular situation. I think you will either have to talk with the vital statistics department in your state or a lawyer.

No. You can't change history. He is her father and I would recommend you not bad-mouth him around her--it's better to keep silent. As often has you say how horrible he is, she is half of him and it can make her feel badly about herself. Just make sure you get child support.

I had my father's name name removed from my birth cert. after my mom remarried and my father gave up his parential rights. My step father adopted me and his name now appears on my birth cert. Hope that helps.
