He should get a lawyer. The drugs were in his car, so they were in his possession. Next time he'll probably be smart enough not to give permission for a search.

Well first off you should never ever give consent to search any vehicle. If you say no they cannot search without probable cause which means the bag would have to be lying out in plain sight. This is true in ALL 50 States.
Since consent was given and I am assuming that they found a green leafy substance...this is just a misdemeanor and will be a fine usually. An attorney will probably cost more than the fine, but I would recommend consulting with one in your area to be sure.

File a motion to supress as your boyfriend didn't consent to the second search only the first search. I would also attack on the grounds that they didn't have probable cause to stop the car in the first place.

get a lawyer, plead guilty, cop the fine and community service and give up the drugs. they can lead to Death or a stretched butt hole by ending up as someone b*tch in Jail(Gaol)
