It would depend on how it is set up in the court documents. If it is not specified that you split the cost of daycare then the child support should be used to cover daycare.

I'm afraid child support does not cover day care expenses. Your ex can take you back into court and have it ordered that you pay half. And in Ohio, it's only half at the maximum depending on your income. If you aren't earning alot of money, they'll take that into consideration. I will advise you that it's going to be ten times easier to just reach a compromise with your ex. Reason being is that if he/she hauls you back into court for this, they are going to re-examine your child support order as well and adjust it accordingly. So if you are making more money now, it could end up costing you more. One compromise that is court ordered alot is alternating weeks as far as paying daycare. One week you pay and the next your spouse pays. It's simple and basic, but if you choose to do this, please let the child care providers know about your arrangements too. That way you can avoid being tracked down if your ex spouse fails to pay.

Most of the time, partial cost of daycare is added into the support judgement, and most states now look at the incomes of both parents, to set up the support amount. You have a right to know where your money goes, so I would ask your case worker(yes, the same one that is handling your child's support cases, is your case worker, too).

You both need to decide how you will cover childcare costs. The courts should not have to dictate everything in your lives. Also, you need to see who makes the most money. Just because he/she receives the child support check does not mean they will be able to cover everything. Sometimes you have to be considerate. Good Luck.
