I haven't seen my husband, Charles Neville in 3 years. We were married in Floyd County, Kentucky in 2002, separated in 2003. Since then, I have been with a wonderful man who wants to marry me and I feel that I am ready to try again. However, I don't want to file for divorce if Charles has already done so. How can I find out if he has already divorced me? I have already tried to do an online records search, but I only get as far as his name in a database and then they want me to pay for anything else. I am looking for a definate answer so I know whether or not I have to file for one before I marry again. Any help is welcome.

In KY you would be served papers for the divorce and given a divorce decree,,, so if you don't have those you best find Charles family and get er done.

It is absolutely, 100% possible to be divorced without knowing. It is required that you be served with papers, IF they can find you. After a certain amount of time, if they are unable to serve you with papers, your husband is required to run an ad in the newspaper with your name and last known address, for 30 days (I think its 30 days). If no one contests the divorce in that time period, the divorce can be finalized without your signature. So I would definetly be contacting a lawyer to find out if this has happened without your knowledge. But you must be sure about this before you attempt to remarry. Unlike what rhondamontford says, there is something stopping you from remarrying...and its the law. It is ILLEGAL for you to be married to more than one person at a time.

Check the court house in the county you got married in if you cant find anything be on the safe side and file for a divorce yourself. I believe you can file under abandonment

Answer's very simple. All you have to do it call Floyd County Court House and ask if your divorced. If they have no divorce papers, then you must file yourself. You can pay a lawyer $250.00 to write up the papers for you, then pay the courthouse $130.00 for a court date. I just went through a divorce this year so I still have my papers. (I did the divorce papers myself instead of waisting $250.00 on a lawyer) You can E-mail me if you want and I can send you the papers and all you have to do is put in you and your Ex's name and other information. I don't know Kentucky law BUT in Texas I was able to get what's called a "Single Signature" divorce, because I didn't know where he was. Check with your state, this may be available, in which case, you simply go to the library and copy the forms from a book and pay the courts to file them. I was divorced in 30 days for less than $100.00. CHECK WITH YOUR LOCAL COURT!

Go back to the courthouse in which you were married and see if anything has been filed there to start with. If the courthouse shows up nothing, try searching for his parents or siblings in a directory to try and locate him. If you haven't filed anything and he hasn't, then you can't legally get remarried. Go to an attorney and ask him to file papers for your divorce. Then tell the attorney you don't know where your husband is, haven't seen him in three years, and the attorney will help you find him....they will hire a PI who will pull the credit records or car tags and find him to serve him with the divorce papers.

If you are in love with this guy and you want to re-marry than do so.You dont need to be embarassed for filing a divorce when he already has.He lives far away and he hasnt contacted you for a long time.So he is not worth it anyway.Go for it if you really love this man.Dont let the past hold you back!.

Who has been stable? If he has been moving from place to place I doubt he has filed for divorce. Have you been moving around that he could not find you?

County court house has records of divorce.

you would definatly know if he divorced you you have to be a part in the court process,someone cannot just divorce you without knowing about it,they would need to find you and then they can file for divorce,find him divorce him and have a happy life good luck to you.
