The answer to this question varies depending on the amount of heroin the offender was charged with and state law. Heroin has no medical use and is extremely addictive. It is a Schedule 1 narcotic and not taken lightly in any state.
In New Jersey for instance possession of just a tiny amount of heroin can get you anywhere from one and a half to as much as 20 years and fines of up to thirty five thousand dollars. If it's your first time getting caught and you get a good lawyer you might be able to plea and get probation or only a few months but even then there are no guarantees you won't get put away for 5 years because some judge spilled coffee on himself 15 minutes before your sentencing.
In North Carolina on the other hand possession of a small amount of heroin gets you 4-5 months on the first offense. But if they catch you with over 4 grams of heroin you get 70-84 months and a fifty thousand dollar fine.

It depends on what the charge is, how many charges and if it was a first offense How much quantity did the person have on them? If it was a small amount of heroin and a first offense, It is a possession charge and you can get PTI (pre-trail intervention = a clean record...after doing a number of things that state requires you to) rehab, or probation. If it was a large amount of heroin or you have been arrested before, then it might be jail time. 2 -3 yrs...but the person would probably get out in 6 mths - 1 yr.

It depends on the circumstances. Like the amount, having weapons with it, resisting arrest, first offense and all that.
Where I live in the Netherlands there is a policy that the police will not harrass the users so long as what they have on them is for private use. But they do take out the dealers and big suppliers as much as they can.

Why don't you worry more about the effect on your life heroin has...that is more destructive in the long run...you can go to jail and get out....addiction keeps you.

depends on a lot of variables. how much did they find? is it local, state o federal? has there been other convictions, not necessarily drug related. what is your age? there is just no easy answer here, sorry. a lot has to do with the judge also. if your lawyer knows the court justices, he'll try ot put you before a judge that is lenient.

it depends on how much you have on you plus if it was with intent to sell or not..maybe just get probation..it really depends on a lot,where you live,what kind of judge you get,if it was on or around school grounds or not, stuff like that!..just remember,you may get off easy on a drug charge but if you keep doing them they may end up killing you! do you know how easy it is to over dose?..i hope your asking this as a hypothetical question!
