In general it is NOT illegal to make a cd or dvd. It IS illegal to infringe on copyrighted intellectual property. Several court cases have set a precedent that you can make a backup copy of software, for example. However, you must have been the purchaser, and you can not give away or sell the copy. This is analogous to the FCC and recordings made from a radio. This same ability came into question when reel to reel recording tape became available to the general public. However, it is illegal to give away or sell the recording. In the recorrding tape example, the FCC ruled that members of the same household did not qualify as giving away the recording. This same thing applied to video tape when that became available. And now, this same precendent has carried over to CD's and DVD's as recording materials which is why the ability is availble to you and me to make our own recordings and copies. The recording industry has fought tooth and nail from the first days of audio tape to quash the ability of the consumer to make their own recordings. When video tapes were introduced, they even futzed with the recorded signals on pre-recorded tapes to prevent making a clean copy, called "Copyguard" as I recall. There are some DVD recorders out there which refuse to copy a DVD because of the recording industry getting a judgement which required the manufacturers to write it into the software. Ever heard of the "region" code in a DVD? It prevents someone from playing a DVD in any other region than where it was purchased on some DVD players. If I purchase a DVD here in the US and send it to my friend in Australia, a perfectly legal thing for me to do by the way, it may not play in his player because he is in a different region.
So, the thing is this; the test is whether you are violating copyrights. As long as you do not give away or sell the material and you legally purchased the CD's or DVD's, then what you do for your personal use in your own home is not ilegal.

The sales for blank media far surpasses sales in actual media but why? Blanks are great for many legal purposes such as data and creative works. When it comes right down to it cd's and dvd's are almost prohibitively expensive and the more expensive they are the more people use the blank media to circumvent legal purchase, plus there are a lot of good sites that allow you to more cheaply download legally the songs you like then in a retail store.

the fact that blank media is made does not mean that you must use it to copy things you shouldn't.... it's been made with the purpose of helping you store more data on a single disc, even dvd's just happen to be called DVD because that is the name of the format, but in the end is nothing but blank media for you to store files in general...
if you have a camera, does it mean you have to spy on people? NO.
if you have a knife, do you have to stick it onto somebody? NO.
same thing with the digital media.

Burning CD's and DVD's is NOT illegal, just people can use it for illegal purposes. You can burn a copy of a DVD movie, for example, to use it for your own personal use if you own the original movie. However, you can't burn multiple copies and give it to someone else or sell it. Thats when it becomes illegal.

The "needles" analogy sort of works, but the responder missed the point: there are significant legal reasons to burn cd's and DVD's--backing up data and making one's own music and movies. Just because needles are sometimes used for illegal drugs doesn't mean they shouldn't be manufactured--what about doctors and nurses that need to use them for their work, or diabetics that need them to give themselves a dose of insulin?

Optical storage media are sold for backup of computer files. you are also allowed to create one (1) copy of any album you purchase for your own use.
