No, the FDA only makes a 'reasonable' finding as to the safety and efficacy of the drug - both of which are subjective evaluations. This is based almost entirely on information provided by the manufacturer. The drug maker is still liable for any false or intentionally withheld information; and thanks to the John Edwards of the world, they can be sued for things which couldn't possibly have been foreseen before actual clinical use.

The FDA doesn't do the studies themselves. Also the drug companies are the ones that HIDE or talk down the actual side effects.
You aren't really going to win that argument.

Sometimes this happens because the drug company has skewed it's research and left out key negative aspects to the drug.

They still get sued for various reasons. A large reason being not listing all possible side effects that negativly affect a persons health.
