if you are just driving with a cell phone that should not be illegal. but if you are talking on the cell phone that should be illegal and you should lose your dl.

Only if they make the following illegal as well:
Driving while putting on make-up
Eating and driving
Drinking (non-alcohol) and driving
Smoking and driving
Listening to the radio and driving
Talking to anyone else in the car and driving
Driving with kids in the car
Cause all are distractions that cause accidents and just as easily if not easier than talking on a cell phone.
What i do think they should make a law is: IF you are in an accident and you were on the phone (whether the accident is your fault or not) then your insurance becomes null and void. Insurance doesn't have to cover anything if you were so busy on the phone that you weren't paying attention.
Being careless or stupid should not be a crime - that's just silly and if it were a crime 3/4 of the US would be in jail just on careless driving alone. You can be careful and do all the things i listed above, as well as talk on the phone, it's people who get cocky that stop paying attention that have accidents. Whether there is a phone in their hand or not.
Hope this makes sense - i know what i am thinking but not sure it is coming out right.

They made it a law to drive with a seatbelt for safety, so why shouldnt they ban cell phones when driving for safety reasons to?
