No you don't finish out their contract. You will have to qualify with your credit to take it over. The cell phone provider requires your SSN to run your credit. IF you qualify, the phone will be put into your name & the bill sent to your email and/or residential address, home or post office box. The contract starts over the month you take over the phone number, either 1 or 2 years, depending on your choice. At that time, you can choose a plan that will suit your phone usage needs, keeping in mind you can upgrade or downgrade the calling plan as you need to. A phone upgrade may be allowed as well, IF you qualified for the phone. A deposit may be required, depending on your credit rating. That will NOT be refunded directly to you, but applied to your cell account when the time frame is up, usually one year.

What phone company is letting you "take over" someone's contract? If someone is trying to convince you to take their phone and pay their bill, you have a golden opportunity to royally screw-up this person's credit. For their own sake, the person should cancel the contract (and pay the fines). If not, you could use their phone until it was shut-off and they would get stuck with the final bill. The person with the contract with the mobile phone company is responsible for the charges on their phone, not you. You didn't sign the contract, and you probably can't adopt the contract responsibilities as some sort of proxy (depending on the laws in your area).

Overall, this is dumb, but mostly for the other person.
