we have been separated since Dec. 2005 and both of us have new partners and both of the couples are expecting babies. Since i am pregnant by someone else, will that stop him from filing for a divorce until i have the baby?

I am living with the baby's father who is my boyfriend, My husband wants a divorce but was told that becuz i am pregnant even though its not his, that he has to wait til i have the baby to file for a divorce. Why is that when the baby isn't his? He left me in Dec 2005 and we have been separated since. he has a girlfriend who is pregnant too and her baby isn't his either. I just want a divorce with no complications.

It is indeeds a complication situations... just ignore your husband since he is the one who raise the divorce issue. You had already known that the baby you are carrying is not your husband but from your bf, why bother to wait for your husband's action? Doesn't make sense at all.
And not to forget that his own gf also expecting but too bad neither his flesh as well.. I never heard such awkward and weird relationship but it is definately a very complicated which you need to solve it in a proper manner.
Just carry on your life and make a firm decision - whether to divorce or start new life with your present bf.

It may it will depend on the state
just go to the clerk of court and file for divorce
they will give you the forms and there will be a fileing fee
you will get a court date after you file
the judge will then tell you what will happen
more then likely you will be able to divorce but you may have to do a DNA test to prove that he is not your childs father
but at least the divorce will be done with
by the way you do not need a lawyer unless you are fighting over property bills children ect
just go get the forms pay the fees and it will be done and over

No, just as long as you dont file for child support, then the divorce would have to wait til the baby is born to do a paternity test, but if you dont ask for support then youll be okay. Now the judge may ask about the circumstances in which this came about to clear allpossible divorce problems but explain it to him and all should be ok. Chances are you wont get spousal support either. Good luck

No it won't stop him from filing an adultry charge against you. Becuase even if you are legally seperated you can still be brought up on adultry depending on the circumstances. It would behoove you to seek an attorney in this matter and don't rely on quacks like me to answer obvious questions like this for you. Each state has their own laws for this matter

No, he can still file. But you said that he was your b/f....you didn't refer to him as your husband.
Totally confused here. Any way you look at it though.....anyone can file for a divorce at any time. Preggo or not.

well it depemds on you's it probably wont stop the divorce it may even make it a little ugly basically depends on who presents the papers first and how the other feels

That depends on him. In most cases it don't because you both have moved on with your lives. Unless he just wants to be spiteful it shouldn't stop anything. By the way good luck with the pregency.

No. That baby has nothing to do with him. He will not be responsible for it, so legally it cannot have any effect on your divorce.

Usually it can and will. I would talk to a lawyer right away. They will want a paternity test done and that usually cant be done until the baby is born.
