It's not a "salary" in sales, it's called a "draw", and yes, it's legal.

It sounds like you misunderstand your pay agreement most likely.

Most sales jobs, the first checks you get are not "salary" but a draw against future commisions, and if you leave a company after getting advanced pay you can end up oweing them 1000's of dollars.

Esp if you sell Insurance where you get commissions on a full year sale and many people drop the insurance before the year you have commisions to pay back

You need to sit down with your sales manager and go over your pay again.

I don't believe so, but I am not well-versed in all the employment laws in the state. I do know that with the company that I work for, our representatives get paid whichever is higher (base pay or incentives). If someone receives a commission and it is not high enough, we make up the difference in that person's next weekly pay check, so that no matter what the rep is guaranteed to make at least the base pay. Ask your employer to explain how the pay program is set up for your company. If you add the specifics to your question, we can better answer it for you.

Yes it is legal, but you should have a defined pay plan that explains it. It sounds like a car sales type of situation or a commision furniture sales where by they issue a salary during your training - its like a lean against future commissions. It bites; and you need to know what it is in writing before you start...lots of people new to sales don't get it.

I don't think it's legal in any state.
