My Dad owned the plot before he remarried.His wife is a terrible woman who forced me into sneaking around to visit or talk to my Dad in his final days. When he died she had him creamated and buried in this plot.My siblings and I were excluded from all the decisions and were not even told about his burial until after it was done.Her son dug the hole for the urn in the family plot with no preacher to pray or anything. The spot where he is buried is next to his older brother and both his parents(his whole family). Now this woman is in the hospital dying and her children are making plans to bury her ashes with my dad's. I have told them I would like if they buried her elsewhere because I don't think she should be buried in his family plot.( My mother was married to my father for 20 years and she never expected to be buried with his family. This woman was only married to my father for 10 years.) Her childrens' view is why should they buy a plot when dad's still has room for her.

When something similar occurred within my family we checked our local city laws and they said the plots fall under real estate and personal property law. In other word's the " Land " belongs to who ever is shown to be the owner of the land. We have a city cemetery and simply checked the purchased records. No one can be buried in this plot without the express permission of the owner. Research who owns the paper on your family plot.
I have sympathy for the children of the dying mother. However if she wanted to have assurance of being buried next to your father she or they should have bought their own plot. These issues in the end only hurt the living.

she was his wife and she was given his name, and so, she has a right to be' family'. now, what kind of person she is, is despite the point.
the cemetary sets its own limits regarding space and according to the laws of the state/city. but, they will not deny her placement in the family plot. but, i would not give a penny towards her funeral or burial. that is my opinion.

If I were in your situation, I would allow her to be buried beside your father if and only if they were married when he passed away. Also I would hope that she was kind to him and wanted to be near him in order to be buried near him.

tell him that she is not ur mother and that plot is from your family, not hers
