I don't have a car. Late one night I was walking home and was hungry and noticed a fast food restaurant had their drive-thru lane open, but the restaurant wasn't open to walk in. I walked up to the window, but they refused to serve me, saying it was against their policy as it could be dangerous for a person to be standing in the drive-thru lane.
I was very upset and felt like I was being treated like a second class citizen. I decided to just stand there and keep repeating the food order. They decided to just ignore my presence. But then a car pulled up and ordered at the order station.
The person at the window got the manager, who came to the window and told me I'd have to move or they'd call the police. I said 'you do what you feel is right. that's what I'm doing.'

The manager left, and I chose to just walk away, feeling pretty down.

Later I realized I could have asked the people in the car to order for me.

Could I have been arrested? What do you think of all this

This happened to me too!!!

I have a car and everything, but that day I had decided to walk there, and it was late at night, so they had closed the lobby, but the drive thru was still open. I tried to order at the drive thru menu, but the person ignored me. I walked up to the drive thru window and asked if she had heard me, but she just denied me service. I was pretty mad. This is actually just a stupid business practice. They're losing money from it.

Yes, you could have been cited for causing a disturbance. It's a matter of safety. You could be run over by a vehicle. The worker has a better chance of ducking for cover from an armed robber in a car after handing over the cash than from a pedestrian that would be able to point their weapon through the window. A person sitting in a car would have to get out first to do that and chances are they will stay behind the wheel to make a hasty get-a-way. Management has the right to refuse service.

You could have been trespassed from the property. The reason they would not serve you is due to insurance regulations. If you had been hit by a vehicle in their drive up lane, while you could have sued the people who hit you, they could sue the fast food establishment. The fast food establishment's insurance will not cover accidents like this.

It is a safety precaution for the people working the restaurant. Not being in a vehicle gives you more freedom to jump through the window and rob the place.

It really is not illegal for them not serve pedestrians. In fact it is dangerous to stand in a drive through because you can be hit by a car.
And to answer you second question:
Yes you could have been arrested for "harassment by communication" which is defined as annoying somebody by words.
Next time go to a different fast food that has seating.

I mean you really have to understand them, if you stand in the driveway and get hit by a car you can potentially sue them for millions of dollars.

I've Thought of the Nights of past when I was Young and Drunk of how I would have driven my 18 wheeler through there Drive Up Lanes if had they refused me as I was parked in their parking lot.. Hmmmm The Idea still appeals to me..

It's a "drive up window." If you don't have a car, you can't use a "drive through." Do you think you're the first person to ever do this a think it's hilarious? College kids have been doing this since they invented the things. Yes, you could have been arrested. No, it's not discrimination. And it's really stupid and unoriginal.

it's not discrimination
no drive will serve anyone would walks up
for security and liability reasons
all it would take is for one moron like you to get hit, slip ect
and out would come the lawsuits and the attorneys
it's a shame there is no law for the stupid and those who can't read

that is just rediculas that thay are willing to loose a custamer. I knoe that these places do not make enough to have both areas open at that time of night. Had you used there name they could and most likely loose more then just you for business. They should realize that they screwed up.

they do have the right to refuse service to whom ever they like and besides that their insurance company probably instructed them to adopt this policy and yes they could have had you arrested for trespassing
