There are just too many factors the judge has to considered in any custody case and because laws differ from state to state it would be difficult to give you a useful answer. There are a lot of factors in deciding which parent a child lives with. It isn't just an age thing. The judge may ask a child as young as 7 or 8, but just because a child has a preferance doesn't mean the judge honrs the child's wishes.

13 in most states. For certain circumstances though, if the child is proven capable to stand trial, they can testify to say which parent they want to live with.

It depends more on how much the child can understand and articulate about their situation rather than a specific age. Kids don't mature at the same rate.

some states 12 years they can ask for emancipation. so if ya want to try call your local district attorney.ask him.
