No. There have been some cases where pregnant women were issued tickets for driving in HOV lanes. They contested the tickets, insisting that their fetii counted as 'passengers' and the courts ruled against them. The point of a carpool lane is to consolidate people who would otherwise be driving their own cars and get more cars off the road, thus reducing pollution, oil consumption and traffic congestion. Since a fetus would not be driving its own car, nor could it go anywhere without its mother, it doesn't count.

No. Its 2 or more visible people. They will pull you over. We got pulled over because my friend was laying down, and they couldn't see her. But they apologized and let us go.
