Once your contract for your previous service expires you can update to a new phone for a discounted price along with a new contract. A contract will last 1-2 years depending on the phone purchased.

The same is true about changing companies. You must wait for the contract to expire or you are responsible for the full price of the phone. Don't forget that a phone that you get free or at a discounted price actually cost at least $100 more than you have paid.

Well, At&t didn't leave, they just merged with Cingular. And yeah, but you may have to wait for your standard upgrade to get a new phone. It usually happens after you have had the plan for 2 years. You can just by the phone outright and change the sim card. Its a bit more expensive but that's the only way to do it without changing your plan. But Cingular has some great plans you should really check them out.
