the wife and the husband did not have any contact in the past 5 years.they seperated due to there differences.The wife wants a divorce but the husband is not willing to let her go.the husband has all the documents.What does the wife do in order to get a divorce.

You dont have to have him in order to get a divorce,walk right into that courtroom and if he doesnt show up after being served,that divorce is yours with no contest,he cant make you stay married to him,especially when the seperation has been 5 years,I dont think you will have any trouble at all getting this one to go threw

If the wife has filed for divorce, and the husband doesn't answer the complaint, have her lawyer file a "default" against him. That way he will be in contempt of the court, and the divorce proceedings can continue without him.

Many states do not require grounds for a divorce, but five years apart would certainly meet the required grounds in the states that do not have a no-fault divorce statute.

Most US states have no fault divorce and you don"t need grounds. Seek legal advice on how to file for divorce. Once you get lawyer they can get documents.

Why can't she file? I'd say no contact for five years is certainly grounds for a divorce.

why would the husband want to stay married to her? just to make it hard on her? in my state i went to divorce my first husband, he was served the papers and never signed them or sent them back, the judge granted the divorce anyway.

She can get a divorce on the grounds of desertion (abandonment, neglect, leaving, forsaking, being/living without him in her home).
