how will the judge decide in the case of mental cruelty since the chances of proof are very low.

The judge can tell just by the way the husband and wife act in the court room. Mental cruelty becomes second nature to the person and when one starts to tell their side the other just cannot sit quiet. They will say or do something to prove it right there in front of the judge. No matter what... the proof is not really all that important.

I went through an ugly divorce. My ex was verbally and emotionally abusive. No one but me saw it. I tried for over a year to get the "inappropriate marital conduct" divorce to work, but because there were no witnesses, I finally changed it to a "no fault" divorce just to get it over with and go on with my life.

There's lots of talk about how it's wrong, but society only sees what it wants to see. If you do have some type of proof, it's invaluable. You MUST present your proof in court. That's the only way you will get it to work.

I wish you the best of luck. Mental cruelty is horrible, I know, I've been there and done that. I've been divorced 2 years and have not yet started dating again, and I don't think I ever will. I just can't trust another person like that again. I will say that I have been happier these last 2 years of my life then I ever was during my whole marriage.

It depends on what you want. If you just want divorce then dont worry. If you are fighting for kids just tell it to the judge who will decide if you are credible. If you are after money then you better get more proof.

In many states mental cruelty is not an accepted reason for divorce. Just be glad you are out of it and he made no trouble.
