Marvel comics, I feel, is the superior brand.
In DC, most heroes are loved by all and they never kill the bad guys because that's not right by them, regardless of the pain and suffering they will unless down the road after they escape. The only character that ever seems to be on the ropes in terms of public acceptance is Batman because he is the "darkest" of the DC heroes.
Marvel on the other hand has a wide variety of heroes, from the loved to the hated, from being lifted up by the public to being labled as public menaces, from light to dark. These heroes deal with super powered issues as well as social issues we can relate to. Racism in the case of the X-Men. The current Marvel Civil War crossover deals with a commentary on the Patriot Act/Gun Control. Using the Civil War event as a reference, we see that people have varying views on super heroes and that even superheroes don't see eye to eye on major issues with the how to tackle earth shattering events. Also, Marvel characters are more likely to know what needs to be done, and act accordingly. Would we really expect characters like the Punisher, Daredevil, Ghost Rider, or Wolverine to beat an enemy into submission and then hand them over to the police? No, we expect them to do what they do, end the threat before it can become greater.

Woot! The 80th time this question's been asked!!! :)

Anyway. it all comes down to personal taste, i think. Both DC and Marvel produce good an bad books. Writers and artists are mostly freelance, so they work for both companies. So quality is generally going to be the same. That said, I currently like DC better. I enjoy the stories more, and DC has a better and more varied reprint program than Marvel does (some of the older stories are much better than current story lines).

This answer regards the comics as opposed to the movies, for which I have a great dislike in general (mostly due to all Batman movies save the most recent, Catwoman, Daredevil, Supermans III and IV, the Hulk and X-Men III).
Both the Marvel and DC universes have their good and bad points, but which is better depends on what type of superhero story you like better. DC is high-heroism, where the superheroes have museums and monuments, sign autographs and battle against cosmic dangers, saving the world on a regular basis. Marvel is dirtier and much harder on its heroes, often ostracizing them due to race, making them criminals and killing them. Harder questions are asked in Marvel, and few heroes get their own museum (and even if they do it ends badly). It's a question of the JLA and the X-Men, and who do you prefer to read? What kind of story works best for you?
I don't think either is better, just vastly different. I began reading X-Men (in the Byrne days) so I am partial to Marvel, but I have many DC titles in my collection. A very hard question.

If you're talking about comic books, both have their good and their REALLY bad.

If you're talking about movie versions, same as above.

I personally like Marvel Comics from WAY back in the day when Chris Claremont wrote them and the X-Men use to be a good read.

I really like Justice League Unlimited and Batman the animated series because Paul Dini's and Michael Reeves's work as well as the others who worked on the cartoon series did an AWESOME job.

Marvel has Spidey, DC has Justice Friends (Batman, Superman, etc.)--so, I'd have to say both are good.
