A company that has hired a sec. guard. co. under a sub-cont. agreement is now requiring said company to carry work. comp. insurance. I'm trying to find support, if there is any, that the sub-contractor can not hold the contract co. liable for bodily injury to the security guards if they are sub-contracted.

It would be written into the contract if there is any provisions for sub contactors. In general, if you have a contract where some or all of the work is sub-contracted, it is up to the company who is doing the sub-contracting to ensure that those people or companies are treated fairly.

Licensed security guard service companies DO by law have to carry some form of workman's comp policy for hired employees. However, company administrators all know where to find the lowest priced comp policies and the ever prevalent loopholes are closely watched.

But that's not to say the company serviced by that guard company is clean off the hook: they TOO can be held liable for any on-grounds carelessness on their behalf that leads to a guard's injuries. And yes: they can demand a security company must carry insurance and workman's comp policies or they don't have their job bids considered.

i do not study safe practices guards being deputized; i have been a Georgia deputy sheriff for over ten years and that i have never heard to that in this state. mostly safe practices guards are nonetheless inner most electorate for the most section. they could in straightforward words make citizen arrests and (a minimum of in Georgia) they're in straightforward words allowed to carry a firearm in the adventure that they have had the right coaching and the gun is in an uncovered holster at the same time as they're in a secure practices uniform. Their element of duty is restricted to the belongings they protect, once they step off of that section their "authority" alongside with it truly is particularly a lot stops. that is now to not say that they could't intrude if someone is being attacked in the approach the line from the position they artwork, yet technically they're in straightforward words appearing as a reliable Samaritan like anybody else passing with the help of and preventing to assist.
