The way the justice system works, NO. There is no way he could be in prison.
When you are arrested for minor crimes, you are first taken to a local jail (city or county), you are arraigned, wait forever - months sometimes, and then after your trial, you may wind up in a prison.
(During the arraignment process, if you are eligible for a bond, a price is set for bail and your friends or relatives or whoever cares about you being out can post your bail and you can avoid the endless wait for your trial to arrive.)
Prisons are run by state and federal agencies, not by local cops.
Also keep in mind that Mel Gibson was arrested for driving while intoxicated, NOT for all of the silly things you have seen under the media microscope.
