Terms and Conditions?

How do these internet companys come up with these terms and conditions? are they prewritten and all that needs to be done is modify them? Can you make one up yourself?

They are all modeled on the same template. Some have different chapters and headings but they are all basically the same. They all say that you are using the product at your own risk and they can disociate themselves from you at any time for any reason, oh and if you want to sue you have to do it in such and such court.
