My friend is a car repair man and he has no drivers licsens, he was using his A.T.V. to pull a dead truck in to his garge, a cop stopped him and told him he was "going to jail for driving on a suspended", but an A.T.V. is a non-licensabl vehicle. How can a cop arrest him for that? Is the cop just being a total dick? or is he just letting that gun and badge of his get to his head? His family called the town maior and reported the cops badge # and his name, cause that was not a valid reson to take him to jail and officer Sorewigglesalot likes to be a dick to alot of people. Im really good with knowing the law and what they can and can't arrest you for, and as far as I knew, they only could write a citation for it and not a jailable offense. Confused in Metamora, IL

You are looking at this backwards. He WAS in control of a motor vehicle (the truck) it was moving and HE was in control of it, that makes him the operator. If the truck was within a locally set distance from a roadway (10 feet here) it is considered to be ON the roadway. This is to protect other people from accidents with abandoned, broken down or under repair vehicles. Harassing the cop is never, ever, ever going to get you anywhere except into a nice cozy cell. Discuss it with the judge and leave the cop alone! From the way you worded your question it is obvious that you have issues with at least this cop if not all cops. Trust me on this one, arguing with a cop is like running in the special Olympics, even if you win, you're still retarded.

Seems fishy.. try calling a local lawyer and simply asking him this question.. they give that info for free ( thats about ALL they give for free) if he says its wrong what the cop did... pursue it vigilantly!
I agree wit hthe above post however, if it was on a road, it may be different than on private property... although I would think if an ATV is not a "registerable vehicle" that it would fall in with a bicycle or something... he wouldnt have arrested your friend for driving a bicycle or if he were incredibly strong-legged, pulling the truck with his bicycle... so Id ask a lawyer, you may have a good case!

Off road he doesn't need a license on road not only is he driving without a license but operating an unregistered vehicle on public roads. If he is in jail though he needs to talk to a lawyer. The lawyer will be much more in the know on the law of the particular state and able to work a deal or get your friend off.

if he was on his own private property they can't even give him a citation. Driving an atv does not require a licensed operator however, it does require registration but still not an arrestable offense if caught without it he would have only gotten a fine. In short the cop was a jerk. I would tell your friend to seek an attorney for false imprisonment and harassment.

If your driving it on a road i suppose you could. but there is nothing illegal driving it on private property or offroading
