My friend has got evicted out of his house which are owned by black people, he was renting it for six (6) years. One of their friends wrote "B***h a*s Ni**a" on the wall. It was written by pushing little holes with a needle. The home owners, are going to try to press charges against them for it.
Is it possible jsut to say that they didn't know since they've been living there for six years to not bring their friend up? If they are sued / charged, what will they be sued with?
Oh, and one more thing, it would be free expression of the 1st amendment, as long as it didn't harm the other. For example, the KKK can march down streets saying they hate blacks legally unless if they promote violence or do any harmful things to anything or anyone.

If the owners want to press it (and there's every reason why they would), they could call the cops on the friend for vandalism and destruction of property, for making the holes in the wall. They could also, depending on the terms of the lease and local laws, sue and/or evict the couple, again for vandalism, destruction of property, breach of contract (assuming there was a standard "no damage to the walls" clause), and (in some states) mental distress, just for allowing the friend to do it.
And no, it's not freedom of expression issue; that only deals with government restriction.

Because it is a bias crime or hate crime, the charges will most likely be upgraded from graffiti or some such thing to aggravated harassment.
It is not considered freedom of expression to vandalize property with racial slurs.
Free expression is to say it to their face and walk away.
Most places take hate crimes very seriously. Your "friend" is in a whole lot of trouble.
Paladin, you are sooooo wrong. A bias crime carries enhanced punishment. If they had vandalized the property with the word "jerk" or "asshole" they wouldn't be in a fraction of the trouble they are in for vandalizing the property with sexual and ethnic slurs.

Hate is not against the law, even misguided hate. That's what freedom is all about. I can hate anyone for any reason, so long as I don't trespass on their rights. Hate crime legislation is an abomination. You either commit a crime or you don't. Your thoughts during the crime don't make it any better or worse an offense.

It's not the words, it's the damage to the wall. He could have wrote "I like steak" on the wall, and the landlord can still take it out of their security deposit.

That is a hate crime, and they defaced property so they'll have to pay for the damages. I don't think they'd go to jail but they would definitely have to pay for the damages.
