How would this restaurant have gotten your checking account information? Your story sounds fishy to me.

If you've been over charged and brought this to the restaurants attention they should eliminate the charge. Now that charge will be held on your account for a few days and than credited back to it. I really don't feel that sueing would be the way to handle the problem. Restaurants are never trying to scam you to get an extra couple of dollars. They make their money from repeat business, the more you go, the more you spend. If other checks didn't clear because of the over charge, contact their corporate office and threaten to sue. Since they always want to avoid bad press and future problems, they will do whatever it takes to avoid any future complications.

The place to start is at your bank. Ask them why they allowed an unauthorized charge to your checking account. Seems the damages would be against the bank. But get their answer, and then talk with an attorney about your next step.

How did they access your checking account? If it was with your debit card, sometimes extra funds are held for a few days. This happens with restaurants, hotels and car rentals.

Contact your bank and ask them abut the process for disputing a charge. They almost certainly have a process in place & people ready to deal with the issue.

ive waitressed for 15 years and i tell you people really need to be careful with credit cards i knew plenty of girls that would over charge or when they left use thiere card number for purchases. i believe you do have rights. hold on to that receipt and stick it up there ***. i hope they fire that server.

A check would've been presented before collection can be made. If someone stole your check you can go after them. If you bounced a check and they redeposited it you are s.o.l

Take it up with your bank. They are the gatekeepers to your $$$ and it sounds like they aren't doing their job!

YOU HAD TO HAVE GIVEN THEM THE NUMBER OR THE DEBIT CARD AND SIGNED....IF NOT SMALL CLAIMS COURT
