Well you gotta read the terms carefully before buying..
Like some seller might sell you just a link on where to buy a RAZR..
Some might sell you a phone that's broken.
That is why you gotta read discription of the phone and the seller terms.. If you agree with them.
Make sure the seller is Paypal certified.. What I mean is they only take paypal payments.
Pay by paypal!!
Ok here goes for the 2nd question.
Its good to buy unlock phones because you can use them with any GSM network providers, just pop in the SIM and ready to go.
Some seller sell phones with plans cheaper. I don't recommend them. Its better to get a plan with a person your talking too. like stores.

I bought one off of eBay (Treo 300) back in the days and it was crap.
Read the ad very carefully. Note every word.
When you get the product, make sure everything the seller says that is wrong is definitely wrong. And if you find something that is wrong and it wasn't listed, then ask for a refund.
Do not "take over service". Get one that is unlocked and start a new service. You don't know what the last user did with his/her service.
Here's my story. The ad said nothing about a bad battery. When I got the Treo, the battery would last about five minutes and die. Charging it did not help. Totally dead.

Even though the ad may tell you that the phone is compatible with your service, as the seller to give you the ESN off of the phone. It can usually be found int he battery compartment. Once you get the ESN call your provider and ask them to check that it can be used. The provider is the only one who can check the ESN and confirm that it can be activited. Also look at return policies and the sellers policy on if there is a problem. I have bought several phones off of ebay and only had a problem with one of them. The seller was great, refunded my money promptly and then give me a number to call about getting the phone fixed. Basically, I got a free phone that only needed a chip or something replaced, which got replaced for free also.

with store u can have trust, u get reciept, proof of purchase. But from ebay, is not that easy. I mean with ebay, when u buy, it may work for 1st month or 2, but then later on year if it doesnt work, u dont have a reciept to take it back and say look i bought it from u and it dont work. If u buy from store u get 1 year warranty (down in UK every customer has 1 year warrenty for free when they purchase electronic item)
Buy only small things from ebay, and cheap things. Things with big money, avoid.

I don't know about buying one from eBay. I would suggest you just go to a local mall--most of them have a kiosk or store for the popular plans. I got my first phone for a penny or a dollar with the purchase of a plan.

E-bay is great the one thing you should keep in mind is the sellers feedback score. The higher the feedback the less likely it's a sham or you'll get screwed. Good luck and have fun!
