Its a federal law that any employee that works over 40 hrs a week unless otherwised specified by a contract between you and said employer is to be paid for said time by being paid wage plus half for said hours worked over a normal week.

Companies get out of paying employees overtime in several ways, which I have been subjected to myself, and am personally going through a case with the Department of Labor in SC.

There are certain clauses that state salespeople who travel are not subject to overtime, and people who are in "expert" professions, such a doctor, lawyer, or something that requires a certain level of expertise is exempt from overtime pay.

This is federal, and not state-by-state

Yes-Bush signed into effect a new OT law in 2002 that stated that employers do NOT have to pay it if they don't want to. However, they can compensate their employees in other ways if they choose. These include extra days off, bonuses, etc..

No, never.....and if any of them try it you just let me know and I'll go and tell them, "No, bad Company--no executive washrooms, no company car for management, no stock options and no more plush chairs to sit around your big old fancy office in. And if they continue it's back to the loading dock for them.
