I know that in some cases it isn't and that makes no sense to me at all.
With it being legal most places to have it illegal is just plain stupid. So my answer would be yes.

I don't know where you live, It is legal in Nevada obviously. I live in California and it is legal on the reservations. We also have a state lottery.

I think it doesn't really matter. The only thing that matter is how you control yourself towards gambling.
