If you were on a jury and the accused had killed his wife after finding her in bed with another man. Would you find him guilty of murder? Or a lesser verdict?
What would be your recommendations regarding sentencing?
After all, murder is murder!

Murder is murder. It doesn't matter whether it is a crime of passion or premeditated. The victim wouldn't care, she'd still be dead. Sentencing should still be severe, not death penalty, I don't believe in it anymore, but jail time should be hard to make the murderer suffer for his actions. Same with any crime really.
I know that's a little harsh, guy caught his wife in the sack with another guy, must really break a man. But there are better ways to deal with a cheating spouse than that.

Did he kill her straight away or wait and plan his revenge?

If the latter then it is straightforward murder. In the heat of the moment it might be manslaughter.

Here in the UK the jury make no recommendation as to sentence, they are there to establish guilt.

You then ruin the question by your last sentence because if you have decided it was murder what is there to answer?

i believe that while murder is murder and no one should get away with it (and self-defense would not be murder), i also make a distinction between the murder commited in a fit of rage and the murder that was coldly planned and carried out. for me, the crime commited in a violent impulse would warrant some jail time, while cold blooded murder would warrant a permanent change of address, either to the nearest high security jail or the local grave yard.
so i guess the deciding factor in my mind would be, did he kill his wife within minutes of finding her in bed with this other guy, or did he do it a week later?

my husband had an affair..( though i did not find him in bed with her luckily), but unless you go through this situation you cannot believe the power of the human mind...and the way it f**** with you :-(...

i have a lot of anger still but i don't think i could resort to murder....but if i ever met the other woman i would not shake her hand politely!!!!!

as you say murder IS murder and if he kills her he should pay for the crime despite it being a 'crime of passion'. he would not only take her life, but the lives of everyone else that cares for her.

If I believed beyond a reasonable doubt that he had killed her in an unlawful manner, I would consider him guilty of murder. Of course variables would apply e.g. 1st (premeditated) Degree or 2nd Degree Murder or manslaughter.

A MAN would almost certainly be convicted of murder.

A WOMAN would almost certainly get away with manslaughter.

Not PC...but that's the way it works.

this is interesting i know of someone that was in the exact position he walked in on his best mate and mrs in his own flat obviusly it was heated and this guy has punched his mate in the nose unfortunately he died on the way to hospital his nose had hit the back of his brain meanwhile this other guy was distraught he didnt mean to do it his charge went from murder to manslaughter and he received 18 months in prison does anyone think he should have been charged with murder? after all it was an accident he didnt intend to kill him

he had options - he could have walked away
he could have just had an arguement
he could have stung her *** during a divorce

why the need for murder?

If it was heat of the moment and there were no records or past of domestic abuse I would be slightly more lenient BUT if he had a past of domestic abuse or if he had walked out of the room gone somewhere else and then come back and murdered her no leniency.

Murder is murder and adultery is adultery which is not punishable by death - in most countries anyway. So he would have to get life in jail with a new 'girl'.
