can an employer withhold your check for 30 days just because you did not give a 2 week notice? This person I know gave 1 week and worked it.

It depends on the state. If your state is an employment at will state, no notice is required and anyone can quit or be fired without notice. If someone leaves, most states require all wages be paid within 24 hours. Your employer is probably breaking the law.

No it's not. An employer is obligated by law to at least mail the check to the employee's address the day it is due to him if the employee cannot pick up the check. The amount of notice a person gives an employer doesn't play a role in how fast or slow he will get his paycheck. I had to argue with a former employer about that. She tried to not pay me until she felt like it. I threatened to call the cops. She paid up FAST!

If you still haven't received the check, send a certified letter to the personnel department (or who ever is responsible for writing your check) notifying them that you have you have not received your check and asking for it in 'x' amount of days. That way, either you'll get the check or you will get a written reason why you aren't getting the check. Good Luck.

Every states different with regards to labor laws. You may want to check with an attorney there.

It may be legal but it is certainly unethical.
