Hell no. Get your own retirement plan. You're leaving her, so you shouldn't be trying to cash in on her benefits, how shallow. Unfortunately for her, if there are funds and investments which you two have shared, due to her hard work, the court will decide how the money/property is to be divided. You should be more concerned with maintaining a decent friendship after your divorce, not how you can hold on to her benefits.

Depends on why you are leaving. If with cause, Yes, 1/2 is yours. Good luck...sound like you are going to need it. Of course, if you have a retirement plan, 1/2 that is hers. IF you do not, I am surprised that she didn't leave your sorry butt. What is it? Has she been supporting you all these years? Nice job if you can get it.

generally you should, depending on the state, also half of her 401k etc - just like she would get half of yours - make a list of everything you can think of and let your attorney know - I love this kind of warm split!
