I don't think so. I've seen babies strapped with a belt onto the driver. You should contact the DMV to find out for certain what the law is.

My personal rule is that the passenger's heels must be able to rest on the passenger footpegs. My cruiser has a backrest too.

I dont know. I think fact is though a cop can't look at your kid and tell his age. My rule of thumb ( I ride and have a 5y/o son) is when he is old enough to put his arms all the way around me and claspe them then he is old enough. Obviously he also has to be able ot get a proper fitting DOT approved helmet.
