You can change your last name to whatever you want to change it to so long as you aren't changing it to hide from creditors. Go to the court house, file the papers and change your name. Common law marriage or not it's your name to change. So while on the topic of common law marriage... does your relationship pass this three part test?
First, you must have "agreed to be married."
Second, you must have "held yourselves out" as husband and wife. You must have represented to others that you were married to each other. As an example of this, you may have introduced you partner socially as "my husband," or you may have filed a joint income tax return.
Third, you must have lived together in this state as husband and wife.
If it does, while you are at the court house, assuming you haven't already go to the Bureau of Vital Statistics and validate it momma! Love and marriage doesn't need a big ceremony but atleast protect yourself in the event that something happens. Without the declaration of marriage you may not be allowed to make medical decisions if he is incapable, you may not be entitled to an inheritance if he passes or even the house that you live in together. Look after your own best intentions and his if anything were to happen to you.

Your can change your name to anything you wish. You just have to petition the court and get it changed. Most common law marriages don't have a thing to do with how long you have been together. How long have you lived together and have you both shared all household expenses.
Last get married for god sakes. You want to change your name to to same last name. Gee!!!!!! What is the matter he doesnt want marry you?

In TX, you are married in common law the same as the marriage certificate from the time either of you acknowledge each other as husband & wife to the public. So, in answer to your question, yes you can change your name, but it would have to be on your SSN, driver's license and other idenity materials. You need to contact the courthouse in your home town to verify that there won't be a problem, and see what you would need.

No, it's 7 years. But you might want to check the rules in your state for common law marriage. I live in Massachusetts and they don't recognize common law marriages anymore. And Ive been with my fiance for 14 years. Good luck.

yes you can my mom did you just got to go to the courthouse and fill out a license my parents were common law married but their divorce was hell because they were married in Texas but moved to Kentucky where common law was not concered legal but they divorced like normal married ppl do
