I have a Company mobile cell phone. I am using it with my own sim card. any way, it was given to me to use because my personal phone had broken and my boss likes to keep in contact with me so they gave me this phone to use. any way i am leaving tomorrow and i would like to keep the phone. When i was 1st given the phone it didnt wrk properly and it was kept as a spare. my boss said "you can have it as long as your nice to me"....well i think I've kept my side of the bargain... but how do i go about asking if they want the phone back or not (the company is of 6 people and fairly laid back as most are family) and i also wonder if they will want it back because phones are out-modelled so quickly....

If the phone really means that much to you, just ask your boss if you can keep the phone. If you can't keep the phone, then surrender it graciously. Did you pay to get the phone repaired out of your own pocket? You would be entitled to give your boss the bill for the service that was performed on the phone if you still have the receipt. Get all your contact numbers out beforehand though.

Your boss is going to be your reference for your next job. Why mess that up over a phone? You want your boss to remember you as a nice person that left on a good note.

There are so many ways to get free phones when you sign up for service.

I suggest you present the argument you mentioned about phones being out-modeled along with proof that the user account is in your name. If you are leaving on completely good terms you will likely walk away with it, but if there is any uncertainty this is a time when people can become very petty.
Still, for the same reasons you mentioned, parting with the phone shouldn't be the biggest deal and as a last resort, only if an argument arises, kicking you old employer $10-20 for it should settle everything amicably. Regardless, it would be a mistake to not bring it to the attention of your soon to be former employer.

Its better to be safe than sorry in this case. I don't know the details of your departure, but I personally wouldn't assume it would be OK to keep their phone, at least without asking first. Offer to return the phone and have it with you when you make the offer. Go ahead and ask them if they would mind if you kept it. They will either accept it back or tell you that you may keep it. Either way, you'll have a resolution.

You should give it back, it is company property. Also, even if you keep the phone and say nothing, what are the chances they won't cut off your service? When it comes to cell phones, the service is what costs, they give the phones away in most basic cases.

The right thing to do is give it back, out dated or not.

I agree about asking to keep/ or purchase the phone. You can change the financial resposibility of the phone to you. Then when they offer you a contract with a free upgrade, you can get a new phone and transfer the sim card.

I don't know what you mean by "being nice" to him. But, I hope you weren't too nice..that would be sexual harassment on his part and against the law. I would think leaving this job is a good idea. Take your sim card and give your boss back the phone.

Who pays the phone bill? Since you say that phones are outmodeled so quickly why not offer to purchase the phone a at a very low price and have the bill transfered into your name?

The right thing to do is ak. Just say “Do you need this phone back?” If you were a good employee and kind enough to ask they might just give it to you. If not, don’t get mad. It was their phone in the first place. Its not worth a bad reference to steal the phone.

I would take my Sim card out and get a new phone. You never know in this day and age...they might accuse you of stealing company property. Better to be safe than sorry.

During your exit interview, paperwork, whatever, simply say, "Oh, by the way, I still have the mobile phone that [the boss] gave me. Do you need a memo or something from me so you can deduct it on the taxes later?"
