It's only a hate crime if they are doing it because and only because the other person is straight. Same goes the other way, if a group of people beat a gay person only because they are gay then it is a hate crime.

I don't think that would ever happen because I have never heard of a gay person being seriously anti-heterosexual. And if there are, they're not hateful enough to the fact where they want to go out and hurt heterosexuals.
And besides, a straight guy hitting a gay person doesn't automatically mean it's a hate crime. The straight guy has to be hitting him JUST because he's gay, not any other reason. If it's any other reason, it's just plain assault.

IF a gay guy hits a straight guy specifically because he's straight, then yes. That doesn't tend to happen all too often though. (Not saying it doesn't happen, but I will say I haven't heard of it yet). Whereas there's plenty of straight guys who are all kinds of happy to beat up gay guys just because they're gay. The reason hate crimes exist is because in hitting that one person, you're also sending out a threat to ALL people in that person's "group". If you're hitting a gay guy because he's gay, that means you'd be pretty likely to hit any other gay person anywhere just because they're gay. It's a whole community that needs protecting, not just one person.

It would be considered a hate crime if the gay person hit the straight person BECAUSE he is straight. Not very likely however.

Its usually self defense. Actually it depends on the terms of the hitting. Many times when a heterosexual hits a homosexual it is not a hate crime. What classifies a hate crime is the motive for an ATTACK. Now, if homosexuals go around ATTACKING heterosexuals, then it would be considered a hate crime.

A hate crime is generally where a crime is commited that is motivated by a particular group especially where people in that group have no choice in being in that group (i.e. Black People or Handicapped)
In many states have laws protecting agianst sexual orientation. By definition the law is supposed to protect all orientations. However, it is up to judges to determine whether that law applies to straight people or not.

properly I somewhat have been a victom of a hate crime i won't have been beat up or something like that yet....My residing house i replaced into residing with my ex gf we wakened to our landlord asking us to stroll out to the front of the residing house close to our shed. on the shed replaced into the word LESBIANS with a arrow pointing to our mattress room window. And swastika's have been spray painted everywere on and close to our property. For a week after this took place ppl that we in no way seen the faces could scream DYKES!!! and different issues at us it finally stopped whilst have been had the law enforcement officers called to check out. So it rather is in basic terms a generalization many ppl chosen the femme gays b/c they're extra obtrusive yet there are lesbians and trans ppl that are attacked besides. extra the butch lesbians than the femme lesbians are attacked besides. not continuously the femme gays are attacked all kinds are attacked u in simple terms hear with regard to the obviuos gays. motives ppl attack gays is via the fact they're ignorant and cowards and in basic terms upload to the soreness and suffering.

actually it depends on the situation...just cuz a str8 guy hits a gay guy doesnt make it a hate crime...its assult... if you hit a gay guy just becuase hes gay then yes its a hate crime...and vice versa.

It depends on how things went down in both cases. If there are two people fighting for whatever reason then it is assault. Battery.
If harm was done because of a act of hate them I guess it could work in both ways.
