I'm in the military and I'm stationed in NC. My wife and I are both from GA and we've been separated for almost 7 months. We also have a two year old son. According to NC law, we have to be separated for a year to file. She has stalled signing the separation agreement that we both came up with. In 15 months, I'll be getting out of the service and moving back to GA. Also, the temporary alimony will have expired by then. If we haven't sealed the deal by the time I move back to GA, could I possibly file down there? The requirements for child support, etc would obviously be different, I'm trying to get this done before I deploy to Iraq in February (ideally). But before I threaten to take this to a different arena, I need to find out if it's possible. Is it possible?

Hopefully the threat of moving the case to GA would prompt her to get it done asap here in NC, because she wouldn't get quite as good of a deal down there.

Get it done now. Might have some more unforseen red tape that could prolong it after you deploy. Google the best state requirements for blah blah blah blah...

Is there anyway that you 2 could work it out for your child? You are going to go to Iraq and may die. Wait until you come back from Iraq safely and then proceed with divorce.
