Question, while a divorce is pending and there is children involved how does the child support thing happen while everything is up in the air, I have a cousin who is going through that and she need to know she is the mother of 5.

Here's the thing, she got pregnant by another man while married, would that make a difference in the divorce?

She can go apply for child support. Just because the divorce isn't final doesn't mean that he doesn't have to pay child support. If they've been apart for 6 months or more then there legally separated. If he doesn't pay, when the divorce is final, he will have to back pay for the months he didn't pay. Reguardless of how long they've been apart, he still owes child suport.

****She committed adultry. That will hurt her with the divorce, but it shouldn't with the shild support. He still has a responsibility to his kids.

In Ohio, when a person files for divorce they also file a motion for temporary orders such as temporary custody, child support, house, etc. A hearing is set immediately on the matter, and it is decided immediately so that until the divorce is final which could take years (not usually unless there's a lot of money) those things are covered. If she's already filed and this wasn't part of it she needs to talk to her lawyer. If she doesn't have one she needs to get one. States are different on their divorce laws, but something to this affect has to be in place everywhere. I'm a divorce lawyer. Good Luck to her!!

She needs to see a lawyer pronto who can order child support for her pending the divorce.

First of all, since you are not the mother in this......you need to mind your own business! I would think that she would have enough brains to contact an attorney! This is her problem, sweetie.....don't make it your problem!
